1. FORMULAE
Charles Herbst is the owner of all formulas as well as all of their derivatives. All rights of any kind, which are not expressly granted by License, are entirely and exclusively reserved to and by Charles Herbst. You may not sell, rent, lease, transfer, modify, translate, reverse engineer, or create derivative works to sell based on any of these formulas unless formulas have been created expressly and exclusively for a client under a mutually negotiated signed contract and for a negotiated fee which has been paid in full. At such time said formula will be delivered to and will become the property of the client and a non disclosure agreement will be enacted. Research and development of a particular product is a billable service and does NOT entail the client’s ownership to the developed formula. Under no circumstances do private label clients have or retain any rights to formulas used in the manufacture of their products. Formulas supplied by clients who have entered into a contractual manufacturing/distribution agreement with Serf to Surf Products Incorporated retain the rights and exclusivity to all supplied formulae and are protected by a signed Non Disclosure Agreement. Reverse engineering of ANY of the proprietary formulae, developed and exclusively owned by Mr. Herbst will be prosecuted to the full extent of the law.
2. GRAPHIC DESIGN AND LABELING
All graphics which were developed and designed by Carlos or a contracted artist in the employ of Serf to Surf Products Inc., as part of a private label project are the exclusive property of Charles P. Herbst unless graphics and/or labeling have been created expressly and exclusively for a client under a mutually negotiated signed contract and for a negotiated fee which has been paid in full. At such time said graphics will be delivered to and will become the property of the client.
You may not copy, download, reproduce, modify, publish, distribute, transmit, transfer or create derivative works from the content without first obtaining written permission from Carlos (*except where noted)
3. SUBMISSIONS
We welcome your comments regarding the Serf to Surf Web Site. However, any notes, messages, ideas, suggestions or other communications sent to Serf to Surf through the Serf to Surf Web Site will become the exclusive property of Serf to Surf Products Incorporated. Private Label Private labeled products are created expressly for the client at the quantities and flavors/fragrances and styles requested. Private label products are also prepaid due to this fact. As they cannot be restocked or resold in a reasonable time there are no refunds on private labeled products. It is the responsibility of the client to exercise due diligence in regards to local import legislation, in regards to and/or any of the essential or carrier oils included in the manufacture of provided products. It is the responsibility of the client to review and correct labeling that does not conform to the health and labeling regulations of your particular country. As these laws and regulations vary from country to country and region to region it is impossible for us to research each and every regulation. Labeling, once accepted and signed off by the client will be subject to a fee if re-writing and re-application apply. The customer will also be responsible for return shipping charges to enable re-labeling and return to the client.
